These Terms of Service govern your access to and use of the WatalkAI platform, APIs, white-label reseller tools, and automation services.

Acceptance of Terms
By creating an account or accessing the WatalkAI platform, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or agency, you represent that you have authority to bind that entity to these terms.
Acceptable Use & Anti-Spam Policy
WatalkAI enforces a strict zero-tolerance policy against spam, un-consented messaging, and abusive activities on WhatsApp. You agree to:
- Send messages only to contacts who have explicitly opted-in to receive communications from your business.
- Comply with Meta's Commerce Policy, WhatsApp Business Terms, and local anti-spam regulations (e.g. TCPA, GDPR).
- Immediately cease messaging any user who requests an opt-out (e.g. STOP).
- Avoid using the platform for illegal, misleading, deceptive, or malicious campaigns.
Subscription Plans & Billing
SaaS subscription fees are billed in advance on a monthly or yearly recurring basis according to your selected plan.
- Meta Conversation Charges: Meta WhatsApp Cloud API conversation fees are charged separately directly by Meta or billed transparently based on Meta rate cards.
- Cancellations: You can upgrade, downgrade, or cancel your subscription at any time within your client dashboard settings.
- Refunds: Subscriptions are non-refundable once activated, except as required by law.
White-Label Reseller Terms
Agencies utilizing WatalkAI's white-label reseller features are responsible for managing their own end-client accounts, enforcing acceptable usage, and managing client support under their custom domain branding.
Service Availability & Liability
While we strive to maintain 99.99% Cloud SLA Uptime, WatalkAI is provided on an "as is" and "as available" basis. We are not liable for third-party network outages, Meta platform suspensions caused by user policy violations, or indirect business losses.
